Acceptable Use Policy - Posh Celebration

Effective date: 1st October 2025
Applies to: All users of Posh Celebration (“Posh,” “we,” “our”), including Hosts (B2C/B2B), Vendors (and their staff/subcontractors), and visitors.

This AUP sets the rules for using Posh websites, apps, messaging, payments (including escrow), listings, reviews, and APIs (if applicable). It is part of our Terms & Conditions and references the Refund Policy, Anti-Bypass Policy, and Privacy Policy. If you disagree, do not use the Platform.

1. Core Principles

  • Safety & legality first. All activity must be lawful, safe, and compliant with venue rules and permits.
  • No deception or harm. Do not mislead, endanger, harass, or harm others.
  • Respect the marketplace. Keep transactions on-Platform, honor escrow, and follow our dispute processes.
  • Data & privacy. Handle personal data responsibly and only as necessary to deliver the event.

2. Prohibited Uses (Platform-wide)

You may not use Posh to:

A. Illegal or dangerous activity

  • Plan/enable unlawful events or activities; procure illegal goods/services; violate licensing, occupancy, noise, alcohol, fire, crowd, health or safety codes.
  • Handle restricted items/services without permits (e.g., fireworks/pyrotechnics, firearms/replicas, hazardous materials, paid raffles/lotteries, medical procedures).

B. Harm, abuse, or exploitation

  • Harass, bully, threaten, stalk, or endanger any person or group; facilitate hate, violence, or exploitation (including minors).
  • Create unsafe conditions (e.g., overcrowding, blocked exits, lack of trained staff for high-risk activities).

C. Fraud, deception, or interference

  • Misrepresent identity, credentials, availability, pricing, or scope; submit fabricated evidence or reviews.
  • Interfere with events or vendors; disrupt fulfillment; file bad-faith disputes/chargebacks.

D. Marketplace circumvention

  • Bypass Posh fees or escrow; steer users off-Platform for opportunities introduced via Posh; share direct contacts prior to escrow with the intent to transact off-Platform. (See Anti-Bypass Policy.)

E. Intellectual property & privacy violations

  • Upload or use content you don’t own or lack rights to; evade copyright, trademark, publicity, or privacy laws.
  • Record or share images/audio of individuals without appropriate consent, where legally required.

F. Spam, scraping, or security abuse

  • Send spam, bulk or automated messages without consent; run unsolicited promotions.
  • Scrape data, probe or scan systems, reverse engineer, or attempt to bypass technical controls.
  • Upload malware or perform denial-of-service attacks.

G. Discrimination

  • Refuse service or set terms based on protected characteristics (e.g., religion, ethnicity, gender, disability) where prohibited by law. Reasonable safety, skill, or venue requirements are allowed if applied consistently.

3. Vendor-Specific Rules

Vendors (including planners, venues, décor, catering, AV, artists, photographers, rentals) must:

  1. Comply with law & permits. Maintain licenses, tax registrations (e.g., VAT/BIN), insurance, and required certifications (e.g., food safety, fire NOC) for your services and locations.
  2. List accurately. Provide truthful descriptions, inclusive pricing, availability, prep/tear-down time, and capacity limits.
  3. Deliver reliably. Meet call times, staffing levels, and scope. Flag risks early; agree change orders in-app.
  4. Use Posh rails. Quote, book, and accept escrow on Posh; do not solicit off-Platform payment for Posh-introduced work during the Non-Circumvention Period.
  5. Protect data. Use guest/host data only to deliver the booking; do not add to marketing lists without consent.
  6. Subcontractors. You are responsible for ensuring your subcontractors follow this AUP and our Terms.
  7. No misclassified items. Do not list prohibited or restricted products/services (pyro, illicit substances, etc.) or mislabel them to bypass review.
  8. Returns & losses. For rentals, follow check-in/out with counts, photos, and time stamps; charge only agreed replacement rates.

4. Host-Specific Rules (B2C/B2B)

Hosts must:

  1. Provide accurate briefs. Dates, locations, headcounts, budgets, dietary or venue constraints must be accurate and kept updated.
  2. Respect safety. Meet venue rules and legal requirements (permits, alcohol service, crowd limits).
  3. Stay on-Platform. Do not solicit off-Platform quotes or payments for Posh-introduced vendors during the Non-Circumvention Period.
  4. Use escrow & dispute flows. Pay via Posh; avoid side payments that undermine protection.
  5. Act fairly. No abusive chargebacks or fraudulent claims.
  6. Corporate buyers. Flag procurement constraints early; if your company requires direct vendor payment, coordinate with Posh so escrow/commission compliance is preserved.

5. Listings, Media & Reviews

  • Allowed content: honest descriptions, accurate pricing, original photos/videos, and reviews based on genuine experiences.
  • Prohibited content: nudity/pornography (non-artistic), hate symbols, illegal activity, doxxing, private info (IDs, card data), manipulated reviews, undisclosed incentives.
  • Moderation: We may hide, edit, or remove content that violates this AUP or applicable law.
  • Licenses: By posting, you grant Posh a license to host and display your content to operate the marketplace (see Terms).

6. Messaging, Calls & WhatsApp

  • Use Platform messaging/bridged calls until escrow is set.
  • No mass marketing, phishing, or off-Platform steering.
  • Keep communications professional; do not share sensitive personal data not needed for the event.

7. Payments, Escrow & Chargebacks

  • Pay only through Posh (card/bank/BNPL) unless Posh authorizes an exception.
  • We may hold or reverse payouts for suspected fraud, bypass, or unresolved disputes.
  • Filing a chargeback pauses our process; abusing chargebacks may result in suspension.

8. Rate Limits & Automation

  • Do not create multiple accounts to evade limits, spam, or manipulate rankings.
  • API/bot use (if offered) requires written permission and adherence to rate limits and data-use rules.

9. Reporting & Enforcement

Report violations: abuse@poshcelebration.com
(include booking ID, screenshots, and a brief description).
Our actions (proportionate to severity and history):

  • Warnings, education, and content removal
  • Ranking penalties, temporary holds on leads, or promotion bans
  • Withholding/clawback of payouts, adjustments for liquidated damages/fees
  • Account suspension or termination, vendor delisting
  • Referral to venues/authorities where safety or law requires

10. Examples (Guidance, not exhaustive)

  • Not OK: “Cancel the Posh order and I’ll do 10% cheaper direct.”
  • Not OK: Listing fireworks without permits; offering alcohol service by unlicensed staff.
  • OK: Declining a booking that exceeds legal capacity or lacks mandatory permits.
  • Not OK: Posting another vendor’s photos as your own; soliciting reviews with undisclosed incentives.
  • OK: Charging a pre-disclosed replacement fee for a lost rental item with check-out evidence.

11. Privacy & Data Protection

Use of personal data must follow our Privacy Policy. Vendors are independent controllers for their own customer records and must comply with applicable data laws. Do not export or repurpose Platform data beyond what’s necessary to deliver the booking.

12. Jurisdiction & Conflicts

This AUP is governed by Bangladesh law and applies globally to Platform use. If local law grants stronger mandatory protections to consumers or workers, those rights prevail. In case of conflict, Terms & Conditions control.

13. Changes to this AUP

We may update this AUP for clarity, safety, or legal reasons. Changes are effective when posted with a new effective date. Material changes will be communicated reasonably.
